What is the minimum legal age to buy tobacco in Portugal?
Portuguese law sets a single, unambiguous age threshold for buying any tobacco or related nicotine product, whatever the sales channel.

In short
In Portugal it is illegal to sell tobacco products, herbal smoking products, e-cigarettes and refill containers with nicotine to anyone under 18. The seller must check photo ID whenever the buyer's age is not obviously well above 18, and the same 18+ threshold applies to vending machines, which by law must have an age-blocking device.
Key points
- The minimum age to buy any tobacco or nicotine e-cigarette product in Portugal is 18.
- Photo ID must be shown whenever age is in doubt; this applies to shops and to vending machines alike.
- Vending machines must have a legally required age-blocking device and be visible to staff.
- The rule covers cigarettes, rolling tobacco, e-cigarettes and nicotine refills equally.
- Selling to a minor is an offence regardless of how the sale takes place.
Where the rule comes from
The age limit sits in Lei n.º 37/2007, the framework law on tobacco control, in the chapter dealing with the sale of tobacco products, herbal smoking products and e-cigarettes. It has been reinforced rather than loosened by every subsequent amendment, including Lei n.º 63/2017 and Lei n.º 5/2024.
The law explicitly names cigarettes, rolling tobacco, e-cigarettes with a nicotine cartridge or tank, and nicotine refills as falling under the same age restriction, so no product category is treated as an exception.
How age is checked in practice
In a shop, the person responsible for the sale is expected to ask for a valid photo ID (citizen card, passport or driving licence) whenever there is any doubt about whether the customer is over 18. Refusing a sale on that basis is a legal obligation for the seller, not a discretionary choice.
For vending machines, the law requires an electronic or mechanical blocking device that prevents access by minors, and the machine must be positioned inside the premises where staff can see it, not in corridors, entrances or shared areas of shopping centres.
What this means for delivery
A delivery model does not change the age rule: the same 18+ threshold applies, and whoever completes the sale carries the same responsibility to confirm the buyer is an adult before handing over any tobacco product.
LUME only takes orders placed on WhatsApp between 19h and 05h and is for adults 18 and over; it does not operate a public shop or vending machine.
Who is legally responsible
Responsibility for checking age sits with the seller, not with the buyer's word alone. Selling to a minor is an administrative offence under the tobacco control law, independent of whether the minor claimed to be older.
Common questions
- Is 18 the age limit everywhere in Portugal, or does it vary by municipality?
- It is a national rule set in Lei n.º 37/2007 and applies uniformly across Portugal, including Lisbon; municipalities do not set their own age threshold.
- Does the age limit apply to heated tobacco and e-cigarettes as well as cigarettes?
- Yes. Since Lei n.º 5/2024 transposed the EU rules removing certain exemptions for heated tobacco, these products are treated the same as conventional cigarettes for sale, age-verification and labelling purposes.
- What ID counts as valid proof of age?
- A citizen card, passport or driving licence with a photograph and date of birth is the standard accepted proof; a photo without an official document is not sufficient.
