Tobacco rules in Lisbon short-stay rentals (Alojamento Local)

A short-stay apartment is not automatically covered by the same national no-smoking rule as a hotel, which is exactly why house rules matter so much here. This guide sets out what a guest should check before assuming they can smoke.

In short

Law 37/2007's list of no-smoking places targets establishments providing accommodation services and other enclosed public and work premises; a self-contained short-stay flat rented as Alojamento Local is a private dwelling for the duration of the stay rather than a hotel-style establishment, so it is not automatically caught by that specific prohibition in the way a hotel room is. What actually governs smoking in a given flat is the host's own house rules — set out in the listing and often repeated in a printed notice on arrival — plus any condominium rules that apply to shared stairwells, lifts, courtyards and balconies in the building, which in Lisbon's older apartment blocks are common and are enforced by the condomínio rather than by tobacco law. A guest should read the listing's rules before booking and ask the host directly if smoking, including on a balcony, is unclear.

Key points

  • A short-stay flat is not automatically a no-smoking establishment under Law 37/2007 the way a hotel is.
  • The host's house rules, not national law, usually decide whether smoking is allowed inside a specific flat.
  • Building-wide condominium rules can still restrict smoking in shared stairwells, lifts and courtyards.
  • Cleaning charges for smoking indoors are contractual, agreed with the host, not statutory fines.
  • Even on a legal balcony, close Lisbon buildings mean smoke reaches neighbours easily — consider them.

Why a rental flat is different from a hotel

Hotels and similar tourist establishments are named directly in Law 37/2007's list of no-smoking places. A licensed Alojamento Local unit — the regime under which most Lisbon short-stay flats operate — is registered and inspected for safety and hospitality standards, but as a self-contained dwelling during the guest's stay it does not sit on that same list the way a hotel reception, corridor or breakfast room does.

That legal gap is why the host's own rules, not a national indoor ban, are usually what actually decides whether smoking is allowed inside a specific flat.

What to check before you book or arrive

House rules on booking platforms typically state smoking policy explicitly; if it is not mentioned, message the host rather than assuming either way. Many Lisbon short-stay listings prohibit smoking indoors specifically to protect soft furnishings, air quality for the next guest, and fire-insurance conditions.

A breach of a no-smoking house rule is a contractual matter between guest and host, which can carry a cleaning charge or, in serious cases, affect a deposit — this is separate from any legal fine, which only applies where the flat or a common area is also covered by the general smoking law.

Balconies and common areas in Lisbon buildings

Many Alojamento Local units occupy floors of older residential buildings shared with permanent residents. Stairwells, lifts, entrance halls and communal courtyards are typically covered by the building's own condominium rules, which can prohibit smoking in shared indoor spaces regardless of what the tobacco law says about a specific flat.

A private balcony attached to the rented flat is not automatically no-smoking under national law, but narrow Lisbon streets and close-set buildings mean smoke can easily drift into a neighbour's window — a common source of complaints in dense areas such as Alfama, Bairro Alto or Mouraria. Being considerate here avoids disputes even where no rule is formally broken.

Common questions

Is smoking automatically banned in an Alojamento Local flat?
Not automatically under national tobacco law, because the flat is a private dwelling during the stay. Whether it is allowed depends on the host's own house rules.
What happens if I smoke against the house rules?
It is treated as a breach of the booking contract, which can lead to a cleaning charge or loss of part of a deposit, separate from any statutory fine.
Can the building stop me smoking on my rented balcony?
National law does not ban it outright on a private balcony, but condominium rules or the host's own terms may still restrict it — check both before assuming.
